Jadhav, 47, was given death sentence by a Pakistani army court in April, following which India moved the ICJ, which halted his execution on India's appeal pending the final verdict by it.

Submitting the countermemorial at the ICJ, Pakistan according to media reports said, "The Indians have not denied that Jadhav was travelling on a passport with an assumed Muslim name".

Dr Faisal said Pakistan had received response from India regarding visit of Indian spy Kulbhushan Jadhav's mother and wife and they would come to Pakistan to meet him on December 25.

While Pakistan claims that Jadhav was arrested by security forces from Balochistan province on March 3 past year after he reportedly entered from Iran, the Indian side maintains he was kidnapped from Iran where he developed business after retiring from the Navy.

The draft reply was jointly prepared by the attorney general, Pakistan's legal team in the case, and officials of the Ministry of Foreign Affairs. "We do reiterate our position that Jadhav remains in Pakistan and is facing death sentence given through a farcical process and on concocted charges", the spokesperson said.

The reply encompasses the charge-sheet against Jadhav and narrates Pakistan's stance in a comprehensive manner.

Claiming that Jadhav is not an ordinary person as he entered the country with the intent of spying, Pakistan in its reply to ICJ said, "Only a state which adheres to legitimate actions can request the court to intervene in a matter between two states".

The reply reportedly also states that Jadhav, who was a serving officer of the Indian Navy, does not fall under the purview of the Vienna Convention.

A staff member from the Indian embassy will also be present during the meeting, Dr Mohammad Faisal said, during the weekly news briefing. "Complete security would be provided to the mother and wife of Jadhav during their visit to Pakistan", he added.
