Avenatti told CNN's "New Day" last week that Clifford would "absolutely" pay back the $130,000 if she was allowed to speak about the alleged affair. By sending the money to Trump, it would involve the President - who has never acknowledged the agreement or the affair - in the case.

The newspaper said the offer to return the money was made in a letter from Daniels' lawyer, Michael Avenatti, to Trump's personal lawyer, Michael Cohen.

If the president's attorneys reject the offer however, it could be seen as acknowledging the existence of the nondisclosure agreement and that it directly involves President Trump. Trump says he had no knowledge of the transaction between Cohen and Daniels.

The letter also asked that the president's lawyers agree that neither Trump nor the shell company Cohen used to pay Clifford would attempt to block the broadcast of an interview Clifford taped with CBS News' 60 Minutes program last week.

Cohen, did not immediately respond to a request for comment on the letter, nor did Cohen's attorney.

The reason Cohen is twisting himself into such absurd logical knots is because if he acted to buy Daniels' silence and boost his client's shot at winning the White House, the payment is nearly certainly an unlawful, unreported campaign contribution.

Good-government groups have questioned the payment Cohen made, suggesting it may have violated election rules - especially after news he arranged the payment with his Trump Organization email address.

The deadline for Mr. Trump to accept the offer is Tuesday at noon.

Almost two weeks ago, Cohen obtained a temporary restraining order against Daniels in private arbitration, where the contract says any disputes about the arrangement must be heard.
