India's cabinet approved a decree making the procedure a punishable offense, as the government had struggled to pass the law in the face of opposition in parliament, even though the practice persists, Law Minister Ravi Shankar Prasad said.

He said the issue of triple talaq has continued "unabated", adding that the government had recorded 201 such divorces since the Supreme Court struck down the law a year ago.

In case the woman prefers to divorce her husband who has subjected her to triple talaq, then the ordinance gives her the right to the custody of her child, and the maintenance for herself and the child is decided by the magistrate.

The Supreme Court had on August 22 previous year struck down triple talaq, calling the practice unconstitutional.

On Wednesday, Congress party spokesman Randeep Surjewala said the government should provide a provision for Muslim women to receive some of their husband's property following divorce.

India's Muslim Law Board had told the court that they did not like the custom, but it opposed any court interference in religious issues.

While the SC had struck down the practice calling it unconstitutional, the Triple Talaq Bill is pending in the Rajya Sabha over a lack of consensus.
